1. General Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (the "Customer", "User", or "you") and Apex Elite (the "Service Provider", "we", "us", or "our"). They govern your access to and use of our website, products, and services.

  • By purchasing, accessing, or using any of our products or services, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms.
  • If you do not agree with any part of these Terms, you must not purchase, download, or use our products.
  • We reserve the right to modify, update, or amend these Terms at any time without prior notice. The "Last updated" date at the top of this page reflects the most recent revision.
  • Continued use of our services after any changes constitutes your acceptance of the revised Terms.
  • You must be at least 18 years old, or have parental/legal guardian consent, to purchase our products.

2. Configs & Software Products

2.1 Sales & Licensing

All configs, software, and digital products sold on Apex Elite are licensed — not sold — for personal, non-transferable use.

  • Your license is tied to your personal account and cannot be shared, leased, rented, or resold.
  • Any attempt to share, distribute, decompile, reverse-engineer, or tamper with our software will result in immediate license termination without refund.
  • Subscription-based licenses (weekly, monthly) are non-renewable automatically unless otherwise stated.
  • Lifetime licenses remain valid for the active lifespan of the product. Discontinuation of a product does not entitle you to a refund.

2.2 Refunds

All sales are final. Once a purchase is completed, no cancellations, exchanges, or refunds are allowed except under specific conditions outlined in our Refund Policy.

2.3 Lifetime Updates & Support

Lifetime-tier configs come with free updates to maintain compatibility with game patches.

  • Technical support is provided for installation, setup, and troubleshooting via Discord.
  • Support does not include help with external software, third-party scripts, or general hardware compatibility issues.
  • Response times are not guaranteed but we aim to respond within 24 hours.

2.4 Game Updates & Limitations

  • Config efficiency and functionality depend on Apex Legends updates.
  • We are not responsible for any temporary or permanent loss of functionality caused by game updates, anti-cheat changes, or platform modifications.
  • We will strive to keep configs updated but cannot guarantee immediate fixes or continued functionality indefinitely.
  • In-game mechanic changes may require modifications or limitations to the config.

2.5 Risk of Account Bans & Liability

  • Using third-party programs or configs violates EA's User Agreement and may lead to account suspensions or permanent bans.
  • While we aim to remain undetected by Easy Anti-Cheat (EAC) and other anti-cheat systems, manual reviews and manual bans remain a permanent risk.
  • No refunds, compensation, or replacement accounts will be issued if your account is banned, suspended, or restricted.
  • You assume full and sole responsibility for any bans, penalties, or restrictions that may result from using our products.

3. Apex Predator Hold

3.1 RP & Level Requirements

Before starting the Apex Predator Hold service, you must ensure your account meets the following requirements:

  • Your account must be below 16,300 RP on all platforms you have played on.
  • If your RP exceeds this limit, you will not be eligible for Predator rewards after the service is completed.

3.2 Nintendo Platform Notice

Due to stricter policies enforced by Nintendo and Respawn:

  • Accounts below level 150 requesting a boost on Nintendo Switch are at high risk of suspension.
  • You must have a minimum level of 150 before requesting this service on Nintendo.
  • Any request not meeting this requirement may be refused or cancelled without liability.

3.3 Bot Lobby Disclosure Requirement

You are required to disclose any previous use of bot lobbies to reach Diamond, Master, or Predator on any platform (PC, PlayStation, Xbox).

  • EA can track activity from previous seasons.
  • Undisclosed bot lobby usage may result in temporary suspensions (up to 90 days) or actions triggered during boosting, especially on Nintendo Switch.
  • If disclosed in advance, the service may be performed on Xbox instead to reduce potential risks.

3.4 Split Reset Policy

If a ranked split reset occurs within the next 24 hours:

  • You must not log into your account until instructed by our team.
  • Failure to comply may result in loss of Predator rewards or rank inconsistencies, especially if exceeding 16,300 RP on another platform.
  • You will be notified once it is safe to log in after rewards have been secured.

3.5 Disclaimer

  • You authorize us to access your account for the duration of the service. We do not store your credentials after service completion.
  • By purchasing the Apex Predator Hold service, you acknowledge and accept all risks associated with account boosting.
  • Failure to disclose relevant information (such as bot lobby usage) may result in penalties outside of our control.
  • We prioritize account safety but cannot guarantee immunity from sanctions enforced by Electronic Arts or Respawn Entertainment.

4. Hardware-Dependent Products

Some of our products (e.g., No-Recoil App MNK version, XIM MATRIX configs) require third-party hardware to function.

  • We do not sell, supply, or warrant any third-party hardware.
  • You are responsible for acquiring compatible hardware independently.
  • No refunds will be issued if the product does not work due to missing, incompatible, or defective hardware.
  • We are not responsible for hardware failures, firmware issues, or driver conflicts.

5. Other Goods & Services

5.1 Bot Lobbies

  • By participating, you agree to follow all rules and instructions provided by our team.
  • Failure to follow instructions may lead to detection, removal, or account flagging.
  • Using Bot Lobbies is strictly against EA's Terms of Service. You acknowledge and accept all associated risks.

5.2 Apex Coins

  • In rare cases (estimated at 1-5% of transactions), you may experience a temporary loss of Apex Coins.
  • Coins typically return within 5 to 185 days due to internal EA reconciliation systems.
  • This delay is beyond our direct control.
  • No refunds or replacements will be issued while the return window is still open.

5.3 Unban Service

  • We offer unban assistance based on experience and strategy, with no guarantee of success.
  • No refunds if the unban attempt fails.
  • By purchasing, you accept that outcomes depend on EA's final decisions.

6. Payment, Chargebacks & Fraud Prevention

  • All prices are displayed in Euros (EUR) unless stated otherwise. Currency conversion fees may apply at your bank's discretion.
  • Full payment is required before product access or service delivery.
  • Any chargeback, dispute, payment reversal, or fraudulent transaction will result in:
    • Immediate termination of all active licenses and services
    • A permanent ban from our store and Discord community
    • Potential legal action to recover losses
  • We may request additional verification (ID, proof of payment, etc.) for suspicious or high-value transactions.
  • Fraudulent or stolen-card transactions will be reported to the relevant authorities.

7. Intellectual Property

  • All content, logos, software, and documentation on this website are the exclusive property of Apex Elite.
  • You may not reproduce, distribute, modify, or create derivative works from any material without our explicit written permission.
  • Unauthorized use of our brand, assets, or software may result in legal action.

8. Acceptable Use

You agree not to:

  • Use our products for any illegal, malicious, or unauthorized purpose.
  • Share, resell, leak, or publicly distribute our configs, software, or documentation.
  • Attempt to reverse-engineer, disassemble, decompile, or modify any part of our software.
  • Exploit bugs or security vulnerabilities in our systems.
  • Harass, threaten, or abuse our staff, support team, or other community members.
  • Impersonate Apex Elite, our staff, or any affiliated person.

9. Limitation of Liability

All products and services are provided "as is" and "as available", with no warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Apex Elite shall not be liable for:

  • Any direct, indirect, incidental, consequential, or punitive damages arising from your use of our products.
  • Account bans, suspensions, or restrictions imposed by EA, Steam, Xbox, PlayStation, or any platform.
  • Hardware or software incompatibility, including system crashes, data loss, or file corruption.
  • Performance issues due to game updates, anti-cheat changes, or external factors.
  • Financial losses, lost progression, lost in-game items, or lost cosmetics.

In any case, our total liability shall not exceed the amount paid by you for the specific product or service in question.

10. Termination

We reserve the right to suspend or terminate any license, account, or service at our sole discretion, without refund, if a customer:

  • Attempts to resell, share, or distribute configs, software, or accounts.
  • Engages in chargeback fraud, disputes, or fraudulent transactions.
  • Abuses support or harasses staff or community members.
  • Violates these Terms or any applicable law.
  • Participates in any activity that damages our reputation, business, or community.

11. Governing Law & Disputes

  • These Terms are governed by the laws applicable to the Service Provider's jurisdiction.
  • Any disputes arising from these Terms shall first be attempted to be resolved amicably via our Discord support.
  • If resolution cannot be reached, disputes shall be submitted to the competent courts of the Service Provider's jurisdiction.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue to be in full force and effect.

13. Acceptance of Terms

By purchasing, downloading, or using any Apex Elite product or service, you confirm that you have read, understood, and accepted these Terms of Service in full, together with our Privacy Policy and Refund Policy.

If you do not agree with any part of these Terms, you must not purchase or use our products and services.
